3.2 Stonkistan expressly disclaims all warranties, express or implied, regarding the accuracy, reliability, completeness, or timeliness of any data. You must not use data from this Site to make live trading decisions.

3.3 Market data is maintained on a 7-day rolling retention window. Historical data availability is not guaranteed.

4. Investment Risk Warning

Cryptocurrency and stock market investments involve substantial risk of loss. The value of investments can go down as well as up. You may lose some or all of any capital you invest. Past performance is not a reliable indicator of future results. High attention scores, radar triggers, or trending status on this Site do not imply that an asset will increase in value. Cryptocurrencies are particularly volatile and may lose all value rapidly.

5. User Conduct & Content

5.1 When submitting comments, feedback, or other content, you agree not to post:

Profanity, hate speech, harassment, or discriminatory content
Spam, promotional content, or unsolicited commercial messages
External URLs, phishing links, or malicious content
Content that constitutes or encourages illegal activity
False, misleading, or manipulative financial information
Content intended to manipulate market prices or sentiment (“pump and dump” schemes)
Personal data of third parties without their consent

5.2 We reserve the right to remove any content without notice and to suspend or terminate access for violations of these Terms.

5.3 By submitting content, you grant Stonkistan a non-exclusive, royalty-free, worldwide license to display that content on the Site.

6. Pro Citizenship Subscription

6.1 Pro Citizenship is a paid subscription service billed monthly via Stripe. The founding rate is locked for the lifetime of your subscription provided you maintain continuous active membership without cancellation.

6.2 Cancellations take effect at the end of the current billing period. No refunds are issued for partial billing periods.

6.3 We reserve the right to modify, suspend, or discontinue Pro features with reasonable notice. In the event of material feature removal, we will offer affected subscribers a prorated credit or cancellation option.

7. Prohibited Uses

You may not use this Site to:

Scrape, harvest, or mass-extract data via automated means without written permission
Resell, sublicense, or redistribute Stonkistan data or content without permission
Circumvent, disable, or interfere with security features or rate limits
Engage in coordinated market manipulation using data from this Site
Impersonate Stonkistan or its representatives
Use the Site in violation of any applicable local, national, or international law

8. Limitation of Liability

8.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Stonkistan, its owners, operators, employees, agents, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

Your use of or inability to use the Site
Any financial loss, trading loss, or investment loss arising from reliance on Site content
Errors, inaccuracies, delays, or omissions in market data or AI-generated content
Unauthorized access to or alteration of your data
Any third-party conduct or content
Site outages, data loss, or service interruptions

8.2 This limitation applies regardless of whether such damages were foreseeable or whether Stonkistan was advised of the possibility of such damages.

8.3 To the extent liability cannot be excluded by law, our total liability to you shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US$50.

9. Indemnification

You agree to indemnify, defend, and hold harmless Stonkistan and its owners, operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit to the Site.

10. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, the “Stonkistan” brand, radar algorithms, AI-generated content, and software, is the property of Stonkistan or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.

11. Third-Party Links

The Site may contain links to third-party exchanges, brokers, and services. These links are provided for convenience only. Stonkistan does not endorse, control, or take responsibility for the content, practices, or policies of any third party. You access third-party sites at your own risk.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Site shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under applicable arbitration rules. You waive any right to participate in class-action litigation or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will indicate the effective date of changes by updating the “Last updated” date above. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. For material changes, we may provide additional notice at our discretion.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
